1. Acceptance of Terms
By accessing or using OwnFit ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
By creating an account, you confirm that you have read and accepted these Terms of Service and our Privacy Policy.
2. Description of Service
OwnFit is a fitness management platform that connects fitness professionals with athletes. Professionals — including personal trainers, nutritionists, physiotherapists, and gym owners — use the web application to manage clients, create programs, schedule sessions, and track progress. Athletes use the mobile application to follow programs, track workouts, communicate with their professionals, and share progress.
3. Eligibility and Account Responsibilities
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age. We do not knowingly collect data from individuals under 18. If we learn that a user is under 18, we will promptly delete their account and associated data.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.
4. Acceptable Use
You agree not to: upload harmful or illegal content, attempt to gain unauthorized access to the Service, use the Service to harass or harm others, or reverse-engineer any part of the platform.
5. AI-Powered Features
The Service includes optional AI-powered features (such as training plan review, exercise progression analysis, workout feedback drafting, and chat reply suggestions) powered by third-party AI providers (currently Google Gemini).
AI features require your separate, explicit consent before activation. When enabled, data including exercise performance, workout feedback, body composition measurements, and chat messages may be transmitted to the AI provider for processing.
AI-generated content is provided as a tool to assist fitness professionals and should not be considered medical or professional advice. Trainers remain solely responsible for reviewing and approving any AI-generated suggestions before sharing them with athletes.
We do not guarantee the accuracy, completeness, or suitability of AI-generated content. You use AI features at your own discretion and risk.
6. Intellectual Property
The OwnFit platform, including its design, code, and branding, is owned by us. Workout programs and content you create remain yours. By using the Service, you grant us a limited license to store and display your content as needed to provide the Service.
7. Professional-Athlete Relationship
OwnFit facilitates the connection between fitness professionals (trainers, nutritionists, physiotherapists, gym owners) and athletes but is not a party to the professional relationship between them. Professionals are solely responsible for the advice, programs, nutritional plans, and therapeutic recommendations they provide through the platform.
8. Limitation of Liability
OwnFit is provided "as is" without warranties of any kind. We are not liable for any injuries, health issues, or damages arising from fitness programs created or followed through the platform.
To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Termination
You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.
10. Governing Law
These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Italy.
11. Changes to These Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email.
